Description

Commissioned by the Department of Foreign Affairs in response to a request from the Department of the Taoiseach, this report (of c. 30,000 words) aims to assess the legislative and regulatory implications of Irish accession to the Antarctic Treaty System (ATS). It gives a fuller picture of the structure and functioning of the ATS, the process of accession to and modalities of participation within it, and maps out the core obligations which would be assumed upon accession, as well as the legislative and administrative measures needed to effectively fulfil treaty obligations. In addition to analysing legal rules and mechanisms in place, the report also seeks to understand the broader political climate surrounding the functioning of the system today and engages comparatively with other states’ experience of participation.
