Abstract
In the rapidly advancing digital economy era, the imperative for robust personal data protection legislation in India has never been more pressing. The Digital Personal Data Protection (DPDP) Act, 2023 ushers in the country’s new era of data governance. This chapter analyses the Act’s multifaceted provisions and examines the implications on businesses, particularly in the digital sphere. Leaning more towards the “conditional” model of data protection, it is found that the DPDP Act provisions to align with global data protection standards. The positive business implications of the DPDP Act are evident from the lack of data localisation requirements and allowances for unrestricted cross-border data flows.
