The article analyses the legal quality of agreements between European Works Councils and the multinational companies in which they are established. Starting from an analysis of the practice of these emerging agreements, it turns to an analysis of the EWC Directive. The article is the first which develops the legal category of enabling legislation, and finds that there is space for European Works Councils and multinational companies to establish a basic agreement which can legitimate European Works Council Agreements. However, the article concedes that it may be difficult to bridge the different legal traditions in EU multinational companies to agree on a model for such agreements.
