Abstract

This article discusses in how far the extension of qualification periods for employment protection and the withdrawal of employment protection for marginal employees can be challenged under the EC's ban on indirect gender discrimination. The German Schröder government's programme, although led by the social democratic party, had some interesting parallels to the UK Thatcher government's programme in this regard, thus it makes for interesting reading also for a UK audience.
