Abstract

The aim of this chapter is to analyse the role of the ICC from the perspective of post-colonialism and the Global South. To this end, the chapter outlines how postcolonial and global south theories have understood the role of international criminal law. This is followed by a critical discussion about the ICC's process of selection of situations and cases by the ICC, and how this reflects colonial interests of the Global North. The chapter then examines the background and content of the decisions of 12 April 2019 and 5 March 2020 issued in the framework of the opening of the investigation in Afghanistan, in order to illustrate how US colonial interests have influenced the ICC's acting in this particular case. Finally, the chapter concludes by analysing the impact of these decisions on the operation and the perception of the ICC by the countries of the Global South.
