Abstract

This chapter rewrites the ICC Pre-Trial Chamber's decision to issue an arrest warrant in the case against Al Hassan through a feminist lens. It is structured as an addition to the original decision, where the authors consider two factors that they believe should have been considered by the Pre-Trial Chamber in deciding to issue an arrest warrant: (1) the use of video evidence and its evidentiary value before the Court, and (2) additional gravity considerations that arise from the fact that the crimes were filmed and posted online.
