Abstract

Considers whether the right to effective participation, protected by ECHR art.6, should apply to the accused whilst in police custody. Examines the potential vulnerability of suspects in this setting and how the concept of effective participation might be conceptualised, referring to ECtHR case law, the Law Commission's work on fitness to plead and the decision in R. (on the application of TI) v Bromley Youth Court (Admin).
