Abstract

The chapter develops a notion of the European Social Model both empirically and normatively, establishing that the EU's Treaty base constitutes an EU Social Model tasking the EU institutions and the Member States to maintain and develop it. It then goes on to criticise the Services Directive, as its regulatory model potentially compromises the EU Social Model, and proposes a restrictive interpretation of the relevant provisions in order to avoid conflict between the Services Directive and the Treaties.
