Abstract

Discusses the questions raised by a number of EU Member States about the draft Directive on copyright in the Digital Single Market art.13, which proposes a requirement that online service providers use content recognition technology to identify copyright material uploaded by their users, including the concerns that such filtering would be incompatible with fundamental rights, Directive 2000/31 arts 14 and 15 and Directive 2001/29 art.3.
